What should I do if I'm stopped by the police?
If you are stopped for drunk driving the police officer likely
observed one or more
signs of a drunk driver. If the officer suspects you
are
driving under the influence
he or she will look for post-stop cues to help determine
your level of intoxication. You may be asked to perform one or
more
field sobriety tests at the scene. The officer may
also request that you take a
chemical test to determine your
blood alcohol content level or (BAC). This may be a
breath test administered by the officer or blood test taken at a
local hospital.
Under the
implied consent law the officer has the right to request
that you take the test. You do have the right to
refuse to take a chemical test, but often the consequences
of refusing the test are more severe than failing it.
Each state and local jurisdiction will have its own procedures
and penalties.
It may be in your best interest to be courteous and
cooperative,
but refuse to answer any questions
until you speak with your attorney.
